Is It Legal To Use Synthetic Urine On A Drug Test?

I’m not usually one for suspense, so I’m going to get right to the point. In every real-world scenario, it is against the law to tamper with a drug test. If that’s all you need to know then you’re good to go, but if you’re looking for the whole story then keep reading.

Consequences of Getting Caught Using Synthetic Urine

The consequences of getting caught are going to vary greatly depending on your state, why you’re taking a drug test, and the specific individuals involved.

In every scenario, you would get in less trouble for outright failing a drug test than you would if you got caught using fake urine. Once you use the fake pee you’re not only a drug user in their eyes – you’re also a fraud. In the eyes of the law substituting a urine test with fake urine, or someone else’s urine is a form of fraud – period.

I’ll talk about the individual states later on, and unfortunately, there’s nothing you can do about the mood of whoever is supervising you. Let’s take just a moment to talk about reasons for taking a drug test and the possible consequences.

Pre-Employment

You just got offered a job, but first, you need to pass a urine drug test. If you get caught then at minimum your potential employer will be notified, and I highly doubt you’re going to get the position. One major point of clarification here as well. Regardless of the status of legal cannabis in your state, the employer reserves the right to deny employment to any person that fails a pre-screening drug test. Because Cannabis is still considered a Schedule 1 drug in the USA, all federal bodies (USPS, Military – all branches, DOT, really any government employment etc.) denies employment to those that fail regardless of substance.

Can you go to jail or get charged with a crime for synthetic or swapping? If your state has laws against fake urine then yes, they will likely report the crime. Otherwise, it is unlikely you would get arrested. In that scenario, the lab tech would have to file a police report and an investigation would have to occur. Again, you can’t account for the vengeance of an overzealous examiner. In all likelihood, this would result in fines because that is all the system involved really wants.

Probation, Parole, & Other Court Mandated Drug Screenings

This section is going to be really easy. In any instance where you are required by law to take a drug test, then it is absolutely illegal to tamper with the test. If you get caught there is definitely going to be legal consequences – period. Especially if you are already on probation, hence why you are taking the test. Really bad idea to pull anything then.

Military

Falsifying a drug test in the military is a huge no-no. At worst it could mean a dishonorable discharge plus time in jail and/or fines. At best, you’re going to likely lose rank and prepare to get chewed out harder than you ever have before. If you are a new hopeful recruit your recruiting officer will most likely drop you.

DOT

If you’re taking a drug test as part of a DOT physical then it’s probably safe to say it has something to do with your job. A job you can likely say bye to if you’re caught using fake pee. Since the DOT operates as a branch of the government you’re more likely to get into legal trouble than you would with a pre-employment screening.

States Banning Synthetic Urine

The following states have adopted some form of legislation banning synthetic urine in one way or another. Some states ban the sale of fake urine, but not possession. Some have laws against both.

Remember, just because your state isn’t on this list doesn’t mean you can’t get into legal trouble for using synthetic urine. Think of it like this – a smoke shop can legally sell you a pipe as a tobacco accessory. You can also legally carry it around with you as long as it is unused. This doesn’t mean it’s legal to use it to smoke weed. In fact, once it has resin built up it’s no longer a tobacco pipe – it’s paraphernalia.

Synthetic urine is similar. Just because it’s legal to buy and own doesn’t mean it’s legal to use to pass a drug test. This is why fake pee is never outright advertised to be used on drug tests. The typical fallback is to say it’s used for fetish reasons. Most states have strict laws against tampering with drug tests which can be used against you even if your state doesn’t have legislation specific to synthetic urine.
